Starting with November 01st 2004, the provisions of Law no. 142/2004 on the amendment of article 2 of the Government's Order no. 66/1999 for Romania's adherence to the Convention on the eradication of the requirement to superlegalize foreign official deeds, adopted in the Hague on October 5th 1961 became enforceable.

The Apostille on the deeds (Marriage Certificates, Birth Certificates, Death Certificates, Criminal Record Checks, Residence or Citizenship Certificates, Study Certificates, Medical Certificates, Baptism Certificates, Religious Wedding Certificates, Seniority in Work Certificates, Certificates of Qualification in Different Trades) is applied by the Prefect's Institution. The certified copies and notarized translations of these documents shall bear a second Apostille applied by the Chamber of the Notaries Public. 

On the grounds of the concluded conventions, the citizens of Belgium, China, Korea, Moldavia and Poland are exempted from the Apostille obligation. We mention that these countries are not part of the Convention of the Hague. The Apostille warrants the official legal acknowledgement. This means that a document bearing the Apostille of the Convention of the Hague is automatically acknowledged and it may be used without any further formality in all the signatory states.

The Romanian deeds bearing the Apostille of the Convention of the Hague are acknowledged in the countries listed below.

For the states that did not adhere to the Convention of the Hague (Brazil, the United Arab Emirates, Kuwait etc.) the superlegalization procedure shall be achieved by the  endorsement of the Romanian Ministry of Foreign Affairs, Ministry of Justice and, where applicable, of the Consulate of that particular country in Bucharest.

The deeds on which the Apostille may be applied are the following: 

- original Birth Certificates, international model;

- original Birth Certificates, international model;

- original Marriage Certificates, international model;

- original Baptism/Religious Wedding Certificates, previously endorsed by the County Directorate of Culture, Cults and National Cultural Patrimony of Brasov city, str. Michael Weiss nr. 22;

- original Criminal Record Check and Driving Records, issued by the Police Department of the area where the applicant resides;

- fiscal residence certificate

- original Certificates attesting the residence and the citizenship of the person or the legal status in Romania, issued by the County Vital Statistics Office, namely the National Inspectorate of Vital Statistics, b-dul Eroilor nr. 8, cam. 2, 0268 416550  int. 177; 0268-414460

- Certificate for the Family Members issued by the General Public Vital Statistics Office

- original Study Deeds, endorsed by the issuing Ministry;

- original Medical certificates, endorsed by the Public Health Directorate of Brasov county, str. M Kogalniceanu nr.11, et. 5-6   - Certificates attesting the seniority in work, endorsed by the County House of Pensions and Other Social Security Rights, Specialty Department,  str. 13 Decembrie nr. 43, Brasov; - Retirement Decision  issued by the County Pensions House - original Certificates of Qualification in different trades, endorsed by the Ministry of Labor, Social Solidarity and Family  - Manpower General Directorate, Bd. Eroilor nr. 5
